Revision of the 1986 Enterprise Bankruptcy Law (Trial Implementation) started in 1994. After 10 years and at least as many drafts, the Draft Bankruptcy Law was formally submitted to the Standing Committee of the National People's Congress in June 2004. The seminar aims at providing an introduction and overview of the Draft Law, noting its possible impact on the PRC reform programme at the macro level, and discussing brand new concepts and arrangements as compared to the existing law at the micro level.
Special reference will be made by the Speaker on the provisions on cross-border insolvencies (Article 8), the creation of the office of an "Administrator" (Chapter 3) and the rather unique discharge provisions in Article 150.
The Speaker will also share his views on new professional opportunities in China for Hong Kong insolvency practitioners following the promulgation of the Draft Law.
Dr. Li is a member of the Drafting Committee of the PRC Bankruptcy Law. Dr. Li obtained his Doctorate Degree from the China University of Politics and Law in 1989 and has been very active in both national and international insolvency research. He has written and published over 100 articles concerning economic reform, corporate mergers and acquisition, restructuring and bankruptcy. Dr. Li was retained by the PRC Government (e.g. the SETC) as consultant in various restructuring and bankruptcy reform studies and projects. Dr. Li has spoken at numerous international conferences and is highly regarded in international insolvency circles.
The admission fee for attending the evening seminar is HKD110 per person for IIG members and HKD200 per person for non-IIG members. The number of places is limited and priority will be given to IIG members on a first-come-first-served basis in case of over-subscription. For members who wish to attend the evening seminar, please complete the attached reply slip and return it by fax for registration on or before Monday, 13 September 2004 and then follow by mail to the Standards & Technical Department of the Society, together with a cheque payable to “Hong Kong Society of Accountants”.
